NEARLY 20% OF NEW OBAMACARE WAIVERS IN NANCY PELOSI DISTRICTS
Of the 204 new Obamacare waivers President Barack Obama’s administration approved in April, 38 are for fancy eateries, hip nightclubs and decadent hotels in House Minority Leader Nancy Pelosi’s Northern California district.That’s in addition to the 27 new waivers for health care or drug companies and the 31 new union waivers Obama’s Department of Health and Human Services approved.Pelosi’s district secured almost 20 percent of the latest issuance of waivers nationwide, and the companies that won them didn’t have much in common with companies throughout the rest of the country that have received Obamacare waivers.
Other common waiver recipients were labor union chapters, large corporations, financial firms and local governments. But Pelosi’s district’s waivers are the first major examples of luxurious, gourmet restaurants and hotels getting a year-long pass from Obamacare
For instance, Boboquivari’s restaurant in Pelosi’s district in San Francisco got a waiver from Obamacare. Boboquivari’s advertises $59 porterhouse steaks, $39 filet mignons and $35 crab dinners.Then, there’s Café des Amis, which describes its eating experience as “a timeless Parisian style brasserie” which is “located on one of San Francisco’s premier shopping and strolling boulevards, Union Street,” according to the restaurant’s Web site.“Bacchus Management Group, in partnership with Perry Butler, is bringing you that same warm, inviting feeling, with a distinctive San Francisco spin,” the Web site reads. Somehow, though, the San Francisco upper class eatery earned itself a waiver from Obamacare because it apparently cost them too much to meet the law’s first year requirements.The reason the Obama administration says it has given out waivers is to exempt certain companies or policyholders from “annual limit requirements.” The applications for the waivers are “reviewed on a case by case basis by department officials who look at a series of factors including whether or not a premium increase is large or if a significant number of enrollees would lose access to their current plan because the coverage would not be offered in the absence of a waiver.” The waivers don’t allow a company to permanently refrain from implementing Obamacare’s stipulations, but companies can reapply for waivers annually through 2014.
Café Mason, a diner near San Francisco’s Union Square, got a waiver too. When The Daily Caller asked the manager about the waiver and how the president’s new sweeping federal health care law was affecting his restaurant, he hung up the phone. The Franciscan Crab restaurant on Fisherman’s Wharf in San Francisco got a waiver. Its menu features entrees ranging from about $15 to $60. The Franciscan’s general manager didn’t return TheDC’s requests for comment.
Four-star hotel Campton Place got one too, as did Hotel Nikko San Francisco, which describes itself as “four-diamond luxury in the heart of the city.” Tru Spa, which Allure Magazine rated the “best day spa in San Francisco,” received an Obamacare waiver as well.
Before hanging up on TheDC, Tru Spa’s owner said new government health care regulations, both the federal-level Obamacare and new local laws in Northern California, have “devastated” the business. “It’s been bad for us,” he said, without divulging his name, referring to the new health care restrictions.But, the spa owner wouldn’t talk about it or the reason his company sought a waiver. He hung up after saying, “I’ve got clients on the other line, good-bye.”
San Francisco Honda, which has two of its three locations in Pelosi’s district, and San Francisco’s Royal Motors Group both got waivers too. Neither called TheDC back.
Blue & Gold Fleet, which describes itself as “the Bay Area’s premier provider of Bay Cruise, Ferry Service and Motorcoach Tours,” got an Obamacare waiver approved in April. The tour service company didn’t return TheDC’s requests for comment.
Nightclub Infusion Lounge got an Obamacare waiver approved in April too. Infusion Lounge calls itself a “sophisticated nightlife destination” with “Asian inspired sub-rosa lounge, fashioned by Hong Kong’s hottest designer, Kinney Chan,” which makes for a “true ultra lounge catering to both dancing hipsters and young professionals looking to relax in style.” Infusion Lounge’s owners didn’t return TheDC’s requests for comment either.
Simco Restaurants and several other affiliated chains based in the area got waivers for their businesses as well. For example, Gordon Yoshida, the manager of memorabilia store Only in San Francisco, told TheDC that Sandra Fletcher of Simco walked him through the process of getting an Obamacare waiver. Fletcher did not return TheDC’s requests for comment.
Pelosi’s office did not respond to TheDC’s requests for comment either.

The Internal Revenue Service (IRS) will see its largest expansion since withholding taxes were first enacted during WWII to enforce the glut of new tax mandates and penalties included in the Democrats’ latest health care plan, according to Rep. Kevin Brady (R-TX).
A new analysis by the Joint Economic Committee and the House Ways & Means Committee minority staff estimates up to 16,500 new IRS personnel will be needed to collect, examine and audit new tax information mandated on families and small businesses in the ‘reconciliation’ bill being taken up by the U.S. House of Representatives this weekend, according to Brady.
“When most people think of health care reform they think of more doctors exams, not more IRS exams,” says U.S. Congressman Kevin Brady, the top House Republican on the Joint Economic Committee. “Isn’t the federal government already intruding enough into our lives? We need thousands of new doctors and nurses in America, not thousands more IRS agents.”
Scores of new federal mandates and fifteen different tax increases totaling $400 billion are imposed under the Democratic House bill. In addition to more complicated tax returns, families and small businesses will be forced to reveal further tax information to the IRS, provide proof of ‘government approved’ health care and submit detailed sales information to comply with new excise taxes.

Unfortunately, according to the Center for American Progress, the structure of the IRS' use of private agencies to collect "debts" encourages abuse. Under the current program, collectors are awarded as much as 25 cents of every dollar they collect, in addition to a $100 bonus for every account they close.
The Internal Revenue Service strategy of paying private debt collectors a 25 percent commission to collect unpaid tax debt originally met with bipartisan resistance from Congress. They claimed that the proposal jeopardized the rights and privacy of American taxpayers. Several organizations voiced their objections to the IRS proposal and have expressed their strong support for the consumer protection legislation Rep. Chris Van Hollen introduced: Citizens for Tax Justice, Consumer Federation of America, Consumers Union, National Consumer Law Center, National Consumers League.
The very nature of the program provides incentives for collectors to push the limits of legality to extract a little more revenue from their targets. As part of the IRS Restructuring and Reform Act of 1998, Congress, fearing overly aggressive collection practices, explicitly prohibited the IRS from compensating its own collectors based on the amount of money they collect. If Congress believes that incentive-based pay will cause official IRS collectors to cross the line, why would they think private collectors would behave any differently?
Although IRS officials indicated that the purpose of the limited implementation phase was to assure readiness for full implementation using up to 12 private collection agencies, the IRS has not documented how it will identify and use the lessons learned to ensure that each critical success factor is addressed before expanding the program even further during the current atmosphere of extraordinary government spending.
Because program's success will be affected by how well IRS makes adjustments, assessing the lessons learned in limited implementation is critical. Also, IRS has not documented criteria that it will use to determine whether the limited implementation performance warrants program expansion.
IRS officials indicated that they are considering criteria that could trigger a go/no go decision, such as the amount of penalties collected from Americans unwilling or unable to purchase health care insurance and there are some indications of PCAs abusing taxpayers or misusing taxpayer data.
Paying private debt collectors on a commission basis is costly and threatens the rights and privacy of the American taxpayers. Congress must ensure, as this resolution seeks to do, that federal tax collection functions will not be handed over to private sector bounty hunters.
Critics of the private collection agency program say that, compared with private debt collectors, whose bad apples star in countless horror stories of debtor abuse and intimidation, the IRS's customer-service-based approach may start looking pretty good to taxpayers.
A recent Center for American Progress report noted that "19% of all complaints received by the Federal Trade Commission (FTC) in 2005 were related to debt collectors, up from 10.5% in 1999. The FTC received more complaints about debt collection in 2005 than about any other industry -- 66,627, a 560% increase over the last six years." The report's writers claim this will likely occur with private agencies working on behalf of the IRS.
IRS officials say they will have a little more than a half year to identify the lessons learned before incorporating them into the next contract solicitation, which IRS intends to release in March 2007.
Related to such decisions on expansion is IRS's planned comparative study of using PCAs. That study is to compare using PCAs to investing IRS's operating costs into having IRS staff work IRS's "next best" collection cases. Under the documented study design, IRS would exclude the fees paid to PCAs from the costs and subtract those fees from the tax debts and health care penalties collected by PCAs.
While such a study might produce useful information, it will not compare the results of using PCAs with the results IRS could get if given the same amount of resources, including the fees to be paid to PCAs, to use in what IRS officials would judge to be the best way to meet tax collection goals.
Adequately designing and implementing the study is important to ensure policymakers are aware of the true costs of contracting with PCAs and know whether PCAs offer the best use of federal funds, while using the least abusive and intrusive tactics to collect tax money owed.
But taxpayer advocate Nina Olsen says that collecting tax revenue is the core job of the IRS, and it should continue to bear that responsibility while protecting taxpayer rights. IRS employees cost only 3 cents for every dollar they collect, making them many times more cost-effective than private collectors.

Students at Belvidere Elementary School could be adding drug testing to their list of lessons when they move into middle school.
The Board of Education will vote Wednesday on a plan to randomly test sixth, seventh and eighth graders to see if they are under the influence of drugs. School administrators said they were confident the proposal would pass.
Elementary School Principal Sandra Szabocsik said school officials want to use the testing “as a deterrent.”
“We’re hoping that the students if they’re at say a party or someone’s house or just hanging out somewhere, that they’ll say ‘I don’t want to get involved in drinking or using any drug because tomorrow could be a drug testing day,’” she told CBS 2′s Christine Sloan.
The program is voluntary and both parents and students must consent. School officials said it was important to note that if a student tested positive, they would not be suspended or have the results sent to the police.
Instead, those students would get counseling or even be referred to a rehab facility.
A number of parents and students in the close-knit town said they would be signing up for the testing.
“It takes the pressure off of them that they have an easy out to say ‘no. No I don’t want to do this, I’m afraid I’ll be tested,’” parent and teacher Noelle Kornegay said.
Drug testing is currently mandatory at Belvidere High School for students who park on campus, join clubs or participate in athletics.
“It’s been working well in the sense that parents and students understand the choices they make and are able to make better ones,” high school assistant principal Joe Flynn said.
“I don’t think it’s to really punish kids as much as to let them realize what they’re doing and the effects it has on their life,” sophomore Jim Debenedetto said.
The district said it wants to convey a similar message to its students — that the tests are not about punishment, but about getting help to those who may be experimenting with drugs. CBS NEW YORK

Obama Administration to Spend $125M to Defend Pro-Abortion Health Care Law
