Pentagon Contradicts Napolitano's Mexican Border Assessment

Secretary of Homeland Security Janet Napolitano’s recent description of a U.S.-Mexico border that’s “as secure as it has ever been" appear to be in direct opposition to a Pentagon assessment.
According to officials at Judicial Watch, a public-interest group that investigates public corruption and fraud, U.S. Defense Department officials believe the border is actually a gateway for Mexican criminal organizations that have infiltrated the entire country and joined forces with terrorist groups. Washington (CNSNews.com) – An illegal alien apprehended by the U.S. Customs and Border Protection agency during the last fiscal year had an estimated 84 percent chance of never being prosecuted, according to figures compiled by the office of Rep. John Culberson (R-Texas).
Culberson submitted the figures for the record during a hearing Wednesday of the House Appropriations subcommittee on homeland security.
Of 447,731 illegal aliens apprehended by the U.S. Border Patrol during fiscal year 2010 (which ended last September), only 73,263 (16.3 percent) were prosecuted, according to the submitted data. That means that 374,468 illegal aliens that were taken into custody (83.6 percent) were never prosecuted.
Border Patrol is a component of the Customs and Border Protection agency at the Department of Homeland Security (DHS).
Describing the situation during the hearing, Culberson said that those who were not prosecuted “had a chance of being home in time for dinner,” after being in custody for a few hours.
He asserted that criminal consequences for those involved in illegal cross-border activity was “the key” to securing the nation’s border with Mexico.
The Texas Republican suggested that Operation Streamline, a program that fast-tracks prosecution and deportations of illegal immigrants crossing the border, should be applied to the entire southwest border.
According to CBP, the operation “targets illegal immigrants apprehended in specific enforcement zones for immediate prosecution for illegal entry. Violators face punishment of up to 180 days in jail. Additionally, deportation procedures are initiated to formally remove the individual once they complete their jail sentence.”
“This is the key,” said Culberson. “If we enforce existing law, impose real consequences and existing laws – up to six months in jail criminal prosecution depending on the circumstances.”
But CBP chief Michael Fisher, who testified during the hearing, disagreed that Operation Streamline was the sole key to securing the border.
There were “a lot of other variables” at play, he said, citing “different judicial districts” with varying capacities to handle the prosecution load.
Culberson maintained, however, that the only consequence “that really has an impact is the criminal prosecution.”
CBP divides the almost 2,000-mile-long U.S.-Mexico border into nine sectors. Running from the Pacific Ocean to the Gulf Coast they are, in order, San Diego, El Centro, Yuma, Tucson, El Paso, Marfa, Del Rio, Laredo, and Rio Grande.
According to Culberson’s figures, of the 212,202 apprehensions along Arizona’s Tucson sector – which is where most of the apprehensions took place in FY2010 – only 30,748 (14.5 percent) led to prosecutions.
Testifying before the House Homeland Security Committee on Feb. 9, DHS Secretary Janet Napolitano told lawmakers that her “top priority in terms of effective control is the Tucson sector of the southwest border.”

The State of Sonora is angry at the influx of Mexicans into Mexico . Nine state legislators from the Mexican State of Sonora traveled to Tucson to complain about Arizona's new employer crackdown on illegal’s from Mexico . It seems that many Mexican illegal’s are returning to their hometowns and the officials in the Sonora state government are ticked off.
A delegation of nine state legislators from Sonora was in Tucson on Tuesday to state that Arizona 's new Employer Sanctions Law will have a devastating effect on the Mexican state. At a news conference, the legislators said that Sonora, Arizona's southern neighbor - made up of mostly small towns - cannot handle the demand for housing, jobs and schools that it will face as Mexican workers return to their hometowns from the USA without jobs or money.
The Arizona law, which took effect Jan. 1, punishes Arizona employers who knowingly hire individuals without valid legal documents to work in the United States .. Penalties include suspension of, or loss of, their business license.
The Mexican legislators are angry because their own citizens are returning to their hometowns, placing a burden on THEIR state government. 'How can Arizona pass a law like this?' asked Mexican Rep Leticia Amparano-Gamez, who represents Nogales . "There is not one person living in Sonora who does not have a friend or relative working in Arizona," she said, speaking in Spanish. "Mexico is not prepared for this, for the tremendous problems it will face as more and more Mexicans working in Arizona and who were sending money to their families return to their home-towns in Sonora without jobs," she said. "We are one family, socially and economically," she said of the people of Sonora and Arizona .
Wrong! The United States is a sovereign nation, not a subsidiary of Mexico , and its taxpayers are not responsible for the welfare of Mexico 's citizens. It's time for the Mexican government, and its citizens, to stop feeding parasitically off the United States and to start taking care of its/their own needs.
Too bad that other states within the USA don't pass a law just like that passed by Arizona . Maybe that's the answer, since our own Congress will do nothing!

Arizona Rancher Ordered by Court to Pay Undocumented Immigrants for Holding Them at Gunpoint
The U.S. Ninth Circuit Court of Appeals upheld a lower court verdict ordering Arizona rancher Roger Barnett to pay damages of $87,000 for holding a group of undocumented immigrants at gunpoint.
The incident occurred in March 2004 when the gun-toting Barnett detained a group of 16 unauthorized immigrants -- none of them carrying weapons -- on public land near the border town of Douglas, Arizona.
He held the group captive with threats that his dog would attack them if anyone moved or tried to escape. Barnett also kicked an woman while she was on the ground.
A federal court jury in Arizona ruled in 2009 that Barnett had no cause to plead self-defense, since he admitted that no one had attacked or threatened him, the Mexican American Legal Defense and Educational Fund noted.
Barnett appealed to the Nirth Circuit, which upheld the original verdict.
"We're very happy with the verdict of the Court of Appeals - the decision sends a strong message that vigilantes will not be tolerated in Arizona," MALDEF's David Hinojosa said in a statement.
Presiding over the original trial was Chief Judge John Roll, who was killed in the Jan. 8 attack on Rep. Gabrielle Giffords at a Tucson shopping center.
This is the second verdict against Barnett.
On Sept. 8, 2008, the Arizona Supreme Court upheld a verdict against the rancher after a jury awarded close to $100,000 in compensation to a Hispanic family, all with U.S. citizenship, who were threatened by the rancher as they were hunting on state land.

Summary: The Treasury Department reports that illegal immigrants filing tax returns using the Individual Tax Identification Number are receiving more than $1.5 billion each year from the federal government through the Child Tax Credit and the Additional Child Tax Credit.
Many illegal immigrants are regularly accessing welfare benefits in the United States in different ways.1 They may do so through those state and local governments that do not verify citizenship or that accept false proof of citizenship. In many cases, they access welfare benefits through their citizen children born in the United States. Additionally, and this is the focus of this report, there are ways illegal immigrants can obtain a form of federal welfare that is available to income tax filers. Since a significant percentage of illegal immigrants have low incomes, work “off the books,” or work with false names and Social Security numbers, it is likely that many report little or no income when applying for federal, state, or local benefits.
An illegal immigrant cannot qualify for a legitimate Social Security number to use to file income tax returns or for any other purposes. Thus, a major facilitator for illegal immigrant access to income tax-based welfare benefits is the nine-digit Individual Tax Identification Number (ITIN) established by the IRS in 1996. It was initially established for people like foreign investors, who are required to file U.S. income tax forms but can not legally obtain a Social Security number. However, the IRS has allowed illegal immigrants to apply for and use the ITIN for filing income taxes returns related to income earned in the United States. Consequently, the ITIN quickly became a vehicle for illegal immigrants to obtain refunds of part or all of income taxes withheld (if any) from their pay and for obtaining refundable tax credits above and beyond any withholding. All but a small minority of people using ITINs today are illegal immigrants.2
Since Congress did not explicitly limit the Child Tax Credit (CTC) and the Additional Child Tax Credit (ACTC) to holders of Social Security numbers, the IRS has allowed ITIN filers to obtain billions of dollars of refund checks related to these tax credits. If the CTC results in negative total tax due, it may be converted into an ACTC, which is the vehicle that the ITIN filer (or Social Security number filer) may use to collect the negative tax in the form of a check from the IRS. By IRS rules, the ACTC is a refundable credit available to individuals with no tax liability.
A Treasury Inspector General for Tax Administration report dated March 31, 2009, “Actions Are Needed to Ensure Proper Use of Individual Taxpayer Identification Numbers and to Verify or Limit Refundable Credit Claims,” indicates that, for the 2007 tax year, Child Tax Credits (774,000 filings for $0.62 billion) and Additional Child Tax Credits (1,220,000 filings for $1.78 billion), together totaling $2.4 billion, were given to ITIN filers.3 By definition, none of the 1,220,000 filers who received the ACTC refunds had any tax liability, and as a group they received IRS checks totaling at least $1.78 billion. The report goes on to say: “While the law also prohibits aliens residing without authorization from receiving most Federal public benefits, IRS management’s view is that the law does not provide sufficient legal authority for the IRS to disallow the ACTC to ITIN filers. Nonetheless, as it now stands, the payment of Federal funds through this tax benefit appears to provide an additional incentive for aliens to enter, reside, and work in the United States without authorization, which contradicts Federal law and policy to remove such incentives.”4
A Treasury Inspector General for Tax Administration report dated December 8, 2009, “Individual Taxpayer Identification Numbers are Being Issued Without Sufficient Supporting Identification,” indicates that total refunds due for new ITINs issued in the January 1, 2008, through November 21, 2008, period were projected to amount to $1.929 billion based on a statistical sampling.5 Without the CTC and ACTC, these ITIN filers were projected to have collected in the aggregate only $0.412 billion of refunds instead of the $1.929 billion, a difference of $1.517 billion.6 The December 8 report goes on to note that, based on a statistical sampling, 87 percent of ITIN applications submitted by Certified Acceptance Agents contained errors, primarily in supporting ID documents being missing or illegible and that “In addition, more than 55,000 ITINs were used multiple times on approximately 102,000 tax returns, with refunds totaling more than $202 million.”7
Any illegal immigrants who in some way obtained Social Security numbers that they could use to file tax returns and obtain refunds (by, for instance, having been legal temporary workers who didn’t depart when they were supposed to) are not included in the above numbers for ITINs. Moreover, such illegal immigrants may have also accessed the Earned Income Credit or the Making Work Pay Credit.

Rhode Island Governor-Elect to Rescind Immigration Enforcement Order
Rhode Island Governor-elect, Lincoln Chafee, announced last week that he intends to rescind an executive order that promotes immigration enforcement within the state. Under the order, state agencies and contractors must use E-Verify to ensure the work authorization of employees. The order also requires state police to enter into a 287(g) agreement to assist Immigration and Customs Enforcement (ICE) in the enforcement of U.S. immigration laws. ( Executive Order, Mar. 27, 2008) By rescinding the order, Mr. Chafee, who ran as an independent, is fulfilling a campaign promise he made to local pro-amnesty organizations. Chafee’s predecessor, Governor Donald Carcieri signed the executive order in 2008 to address the local problems stemming from illegal immigration. In the text of the executive order, Carcieri stated that he was implementing such measures because of the “burden on the resources of state and local human services, law enforcement agencies, educational institutions and other governmental institutions” caused by illegal immigration. ( Executive Order, Mar. 27, 2008) At the time, Rhode Island was home to about 40,000 illegal aliens and faced an estimated $550 million budget deficit, its worst financial crisis in decades. Open borders organizations have been fighting the executive order ever since Carcieri signed it, objecting in particular to local enforcement of immigration laws. The Rhode Island ACLU says the State Police’s efforts are leading to racial profiling. ( The Boston Globe, July 6, 2010) Similarly, Rhode Island Latino PAC director Doris De Los Santos said the police should be spending its time on other matters and that the executive order “create[s] an environment that is not conducive to progress, that has the potential for racial profiling, and that makes people less likely to report crimes for fear of being deported themselves.” (The Providence Journal, Nov. 20, 2010)
Meanwhile, state law enforcement agencies have lauded the executive order that helps them fight illegal immigration. The Commander of the Rhode Island State Police, Supt. Col. Brendan P. Doherty, argues that statistics prove that the order is working. Since the order took effect, 92 individuals were checked through ICE databases, and over half were found to be illegal aliens, some with criminal histories. (Id.) “I would feel that I’m derelict in my duties to look the other way, ’’ said Commander Doherty. (Id.)
Despite the success of the program and Rhode Island’s continuing financial difficulties, Chafee has remained firm in overturning the order as one of his first actions in office. Well whaddya know? It turns out that Rhode Island has long been carrying out the procedures at issue in the Arizona immigration statute: As a matter of routine, RI state police check immigration status at traffic stops whenever there is reasonable suspicion to do so, and they report all illegals to the feds for deportation. Besides the usual profiling blather, critics have trotted out the now familiar saw that such procedures hamstring police because they make immigrants afraid to cooperate. But it turns out that its the Rhode Island police who insist on enforcing the law. As Cornell law prof William Jacobson details at Legal Insurrection, Colonel Brendan P. Doherty, the state police commander, refuses to hide from the issue, explaining,"I would feel that I am derelict in my duties to look the other way." If, as President Obama and Attorney General Holder claim, there is a federal preemption issue, why has'nt the administration sued Rhode Island already? After all, Rhode Island is actually enforcing these procedures, while the Arizona law hasnt even gone into effect yet. MORE HERE

On June 22, Mexico filed a brief in support of overturning the State of Arizonas new immigration law scheduled to take effect on July 29. In the filing, the Mexican government stated that it is concerned for the civil rights of its citizens in Arizona.The brief expresses the Mexican governments support of a lawsuit filed by several groups including the American Civil Liberties Union (ACLU), the Mexican American Legal Defense Fund, and the National Immigration Law Center. Lawmakers in Madison, Wisconsin, the state's capital, unanimously passed the resolution this week because minorities in the area feel that Arizona’s new law will cause backlash all the way to the Badger State, according to a report from the public-interest group Judicial Watch.
Wisconsin resolution asks law enforcement officers and county jail officials not to report illegal aliens who are booked for committing crimes of violence or property crimes to federal law enforcement agencies such as Immigration and Customs Enforcement (ICE). Last year Wisconsin passed legislation that gives illegal aliens discounted tuition at the state’s public colleges and universities, while American citizens living in other states have to pay more costly "out-of-state" tuition and fees.
